Meridian Flows provides Amazon listing optimization tools, ASIN analysis, keyword tracking, and related e-commerce analytics services. Our Service uses third-party APIs and AI technology to analyze product data and provide recommendations.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

  • Free Trial: New users may receive a limited free trial with restricted features and usage limits.
  • Paid Plans: Subscription fees are billed in advance on a monthly or annual basis.
  • Refunds: Subscription fees are non-refundable except as required by law.
  • Price Changes: We reserve the right to modify pricing with 30 days notice to active subscribers.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of Amazon's Terms of Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems (bots, scrapers) to access the Service beyond normal usage
  • Share your account credentials with third parties
  • Resell or redistribute the Service without written permission
  • Use the Service to infringe on intellectual property rights of others

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Meridian Flows Digital (a DBA of Go Out On A LIM LLC) and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any data you submit to the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • Analysis results or recommendations will be accurate or improve your sales
  • Third-party data sources (Amazon, APIs) will always be available

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERIDIAN FLOWS DIGITAL (A DBA OF GO OUT ON A LIM LLC) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Meridian Flows Digital (a DBA of Go Out On A LIM LLC), its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may cancel your account at any time through your account settings.

Following termination or account closure, we will delete or de-identify your account data and uploaded files within a reasonable period, except where retention is required for legal, accounting, or security purposes, as described in our Privacy Policy. You are responsible for exporting any data you wish to retain before termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of New York, and you consent to personal jurisdiction and venue in those courts.

You retain ownership of all data, files, and reports you upload to the Service ("Your Data"). You grant us a limited, non-exclusive license to store, process, and use Your Data solely to provide and improve the Service to you. You represent and warrant that you have the necessary rights to upload Your Data and that doing so does not violate any third-party rights or the terms of any platform from which the data was exported (including Amazon and third-party tools such as Helium 10). Our collection, use, storage, and deletion of personal data are described in our Privacy Policy, which is incorporated into these Terms by reference.

14. Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, internet or utility failures, or the failure, unavailability, or modification of third-party services and data sources (such as Amazon, hosting providers, or third-party APIs) on which the Service depends.
